Mike Orcutt made a motion that the TMC delay in directing the Flow Workgroup to plan for the fall flow augmentation within the ROD volume because the matter is in litigation and will be resolved by the courts. And further the TMC has spoken in past motions that the supplemental flow volumes are not part of the ROD and this was concurred with by the Department of the Interior in 2005. Dave Hillemeier seconded the motion.
